California's AI Transparency Act (SB 942 as amended by AB 853), operative as of August 2, 2026, is the first US law to mandate C2PA content credentials for generative AI systems exceeding one million monthly users in California — with civil penalties of $5,000 per violation per day and no notice-and-cure period. Yet the law exposes a structural flaw in provenance infrastructure: C2PA metadata is stripped when AI-generated images are re-uploaded to Instagram, X, or WhatsApp. A May 2026 adoption study found that while 75–85% of AI-generated images from major platforms carry provenance signals at point of generation, only 30–50% retain them after online distribution. A legal mandate for metadata that does not survive the primary channels through which content actually travels creates a measurable gap between regulatory intent and technical reality — one that SB 942's 2027 phase, which will require large platforms to detect and surface provenance, attempts to close but has not yet addressed.
